Highway Enquiries

Requests requiring a formal written response
The County Council is the Highway Authority for the districts in Leicestershire and holds information about the status and extents of the highway (excluding trunk roads, motorways and City of Leicester roads).  
The County Council has undertaken a review of the current procedure for dealing with enquiries concerning the discharge of the Highway Authority’s functions in relation to land which is proposed to be offered for sale or the subject of a transaction between third parties.  In order to provide a satisfactory response it is necessary for the County Council to allocate staff resources and maintain its records to a suitable standard. Therefore, the Council has implemented charges that are considered to reasonably reflect cost of research and administration for answering these enquiries.
The procedure for handling general highway boundary enquiries and local search follow up enquiries is as follows:

  • There is a charge of £20 for the provision of written information regarding, for example,
                   (i)     clarifying the status of land adjacent to a property, or
                   (ii)    information relating to section 38 Agreements (not clarifying a local search), or
                   (iii)   Traffic Management and Highway Schemes (not clarifying a local search).
  • There will be no charge for information that clarifies traffic management or highway scheme information provided in a local search.
  • There will be no charge for information that clarifies ‘Part Adopted’ roadways given on the County Council's Highway Status Search website.
  • If you require a plan showing the extent of publicly maintained highway in the vicinity of a property, there is a charge of £45 towards the cost of administration. However, if an area of land requires a plan larger than A3 please seek advice as the price may vary. Please see contact details above.
  • There is a charge of £55 for a comprehensive response dealing with a number of issues, for example,
                   (i)    Section 38 Agreements and Adoption information, and
                   (ii)   Traffic Management and Highway Schemes, and
                   (iii)  Highway extents (including a plan), and
                   (iv)  Public Rights of Way, and
                   (v)   Highway Building and Improvement Lines
  • Any enquiry of more than 7 questions may incur a further fee.
  • A cheque, made payable to Leicestershire County Council should be included with your enquiry and an acknowledgement receipt will be attached to the reply.

Important Notice Regarding Fees From 1st April 2009

The fees set by Leicestershire County Council for a response to a Highway Enquiry are correct as of 1st April 2009. These fees have been calculated to reasonably reflect the cost of research and administration for answering these enquiries.
