School Admission and Exclusion Appeals

The County Council is required by Section 94 of the School Standards and Framework Act 1998 to make arrangements enabling the parent of a child to appeal against any decision made on behalf of the Authority about the school that has been allocated.
The appeals are administered by the County Solicitor on behalf of the Local Authority and the Panels who consider the appeals are independent to both the County Council and to the Children and Young People's Service who allocate school places.
In addition, the County Solicitor makes the arrangements for appeals against a decision to permanently exclude a child from school. These arrangements are made pursuant to Section 52 of the Education Act 2002 and associated Regulations.
In both admission and exclusion appeals, the Panel's decision is binding on all parties.

Infant Class Size Appeals

If the statutory maximum of 30 pupils has already been reached by the admission of pupils up to that number then the legislation requires the panel to adopt a different process.  In these cases, the panel, may, by law, only allow an appeal if it is satisfied that:
A, the decision to refuse admission was one which no reasonable admission authority would have made in the circumstances of the case: or
B, your child would have been offered a place if the admission arrangements has been properly implemented.
In these cases the Local Authority will restrict its representation to the panel to issues concerning the implementation of the admissions policy and the panel can only consider submissions that you make about (a) and (b) above.  Your personal circumstances cannot be taken into account by the panel insofar as they relate to (a) and (b).

How is the Oversubscription List operated?

If your application for a school place is refused your application will automatically be put onto the OSL if you have applied on time as part of the normal transfer round or you have applied before the start of the Autumn term.
