Adopted Development Plan DocumentsThe new development plan system comprises of several plans: the East Midlands Regional Plan, the Minerals and Waste Development Frameworks and District Development Frameworks. The new Regional Plan was published in March 2009 and can be viewed on the Government Office for the East Midland's web pages. On 30 June 2009 a partial review of this new plan was launched and details on this can be found on EMRA’s website. The Local Development Frameworks are currently being produced to replace the Local Plans, currently used for determining applications.
Leicestershire County Council is the minerals and waste planning authority for Leicestershire and is responsible for preparing the the Minerals Development Framework and Waste Development Framework. The programme for the production of the Development Frameworks is published within the Council's Development Scheme.
The first documents produced as part of the Development Frameworks have gone through all their necessary stages and the County Council in their meeting of 23rd September 2009 agreed to adopt the following documents which can be viewed below. The actual adoption date for the documents is the 8th October 2009.
Alongside the documents an adoption statement and a sustainability statement have been prepared to explain where the documents are available to view and how environmental, economic and social factors have been taken into account when preparing the plan.
Until all elements of the new Development Frameworks are adopted some of the policies 'saved' from the Local Plans by the Secretary of State remain in use (extant) for determining applications. Those policies are listed as an appendix in the adopted documents above but also in the summary tables below. These have been tabulated below on a simple colour code system with green for policies 'saved and extant', orange for those 'saved but now replaced by the newly adopted documents', and red for those 'not saved'.
Those policies 'saved' were done so via a request to the Secretary of State for agreement to do so. Where policies were out of date or no longer required no request was made to save them. The request by the Council to 'save' the policies can be viewed below:
The Secretary of State issued a Direction dated 21 September 2007 listing those policies that would be retained. This is available to view below:
The Secretary of State's direction 'saved' all the Waste Local Plan policies but only some of the Minerals Local Plan policies.
