Adopted Development Plan DocumentsThe previous development plan system comprises of several plans including the Structure
Plan, Minerals and Waste Local Plan and District Local Plans.
Leicestershire County Council is the strategic, minerals and waste planning authority
for Leicestershire. It was responsible for preparing the County Structure Plan which set out policies
and general proposals of County wide importance for the development and use of land in the County.
Leicestershire County Council was also responsible for preparing the Waste Local
Plan and Minerals Local Plan. The Waste Local Plan extends over the whole County area sets out policies
and proposals for dealing with developments associated with waste management facilities. The Minerals
Local Plan also extend over the whole County and sets out policies and proposals for dealing with developments
associated with Minerals developments. The existing Minerals Local Plan and Waste Local Plans will be
replaced by the Minerals Development Framework and Waste Development Framework.
The programme for the production of the Development Frameworks is published within the Council's
Development Scheme.
The policies contained within the Local Plans were automatically
'saved' for 3 years until 28 September 2007. To retain these policies after this date the Council
has to request the Secretary of State for agreement to do so. Not all policies have been asked
to be saved where they are out of date and no longer required. The Council has sent their list
of policies to be 'saved' and deleted to the Secretary of State. This can be viewed below:
The Secretary of State issued a Direction dated 21 September 2007 in which it was
listed those policies that would be retained for use in determining applications until the Development
Framework policies were in place. This is available to view below:
The GOEM direction saved all the Waste Local Plan policies but some of the Minerals
Local Plan policies have not been retained and these have been tabulated. The table works on a
simple colour code of green for 'saved' and red for 'not saved'. Where policies have not been
retained the text indicates why and where relevant the policy is covered by other policies. This
