- Do I need planning permission?
Yes,
all minerals and waste development, with some exceptions require planning permission. Development not
related to minerals and waste may require planning permission form the local District or Borough Council.

- How can I find out more about planning applications being considered by the County Council?
You can view all current planning
applications and view all planning decision online. See Planning Applications.
- Can the County Council overrule a District or Borough Council Planning Decision?
No the County Council cannot overrule a District
or Borough Planning Decision.
- Can the County Council choose to ignore the Borough / District / Parish Council comments when determining a planning applications?
The
County Council does not ignore any comments received and will always take them into consideration when
determining a planning application.
- Can the County Council choose to permit proposals that may appear to be in conflict with planning policies?
Yes, all applications
should be assessed inline with current Development Plan Policies unless material considerations indicate
otherwise.
- Who is responsible for removing fly tipping?
Your
local District or Borough Council is your first point of contact, otherwise contact the Environment
Agency to have fly tipping removed.
Can I appeal against a planning decision to grant planning permission
when I have objected to the proposal?
No, only the applicant can appeal a planning decision.
- Can I appeal against a decision on my planning application?
Yes,
You have 6 months from the date of the planning refusal or date of permission to appeal a planing decision
or condition. You should contact the Planning Inspectorate also look at the information we have on Planning
Appeals.
- What can I do if I think someone is carrying out works without planning permission or outside the terms of their planning consent?
If
you think the development is related to minerals/ waste/ Leicestershire County Council development and
is being undertaken without permission or contray to a planning permission then please contact us on
the number below.
- What action can the County Council take against someone who is carrying out works without planning permission or outside the terms of their planning consent?
Once
you have reported the incident, the County Council will investigate the situation and take appropriate

- What can the County Council do about reducing or mitigating lorry traffic caused by minerals and waste development?
The County
Council always seek advice from the Highway Authority when determining a planning application that affects
lorry movements. Some permission may include lorry routing and vehicle numbers leaving a site, where
the development might be deemed to have an environmental impact on the local highway network. The county
council has limited powers controlling lorry speeds.
- Do I need planning permission to tip material or waste?
Yes

- What protection is there to safeguard existing trees?
If
you wish to safeguard an existing tree you can apply for a tree preservation order from the District
Council
- What is a Development Plan?
The
english planning system is a plan led system. A development plan is the acculation of various documents.
The development plan should include the Regional Spatial Strategy, Structure Plan, Local District
Plan and either or both the Minerals and Waste Local Plan. These plans include policies in which planning
decisions are determined against and they all include a proposal map.
