Licence Applications relating to Explosives, Petroleum and Poisons

Leicestershire Trading Standards are responsible for licensing in relation to Explosives, Petroleum, Poisons and Performing Animals Registration

Explosives Licence

  • A licence to store mixed explosives (including fireworks) is valid for 12 months commencing October 1st each year.

Petroleum Licence

  • For new petroleum storage where dispensing is involved.
  • Before applying appropriate planning approval and approval from the Trading Standards Service, under the Petroleum (Consolidation) Act 1928, must be obtained.
  • Plans must be submitted to the Service for examination and approval before a licence will be granted.
  • Following approval the Service must be kept informed of building progress and any changes to the approved plans. No building work must be commenced before written approval is obtained.

Poisons Licence

  • The Poisons Act prescribes a list of poisons which are allowed to be sold.  
  • The list is in two parts
    • At retail level only registered pharmacists may sell the poisons in part I of the list.
    • Retail sales of part II of the list are restricted to pharmacists and retailers who register with the local authority. A fee is payable for registration.
  • Many household products contain poisons. Common ones are Caustic Soda (any brand), fly killers, rat bait, weed killers and other cleaning compounds. However, not all such products contain poisons. Some products containing poisons may only be used for particular functions e.g. rat bait, and some may only be sold to particular people e.g. Forresters. There are also some products which require entry into a book of details of the sale and who purchased it.

Performing Animals Registration

  • It is an offence for anyone to train or exhibit a performing animal unless they are registered to do so under the Performing Animals (Regulation) Act 1925. The Act is designed to cover the use of animals in stage performances, at circuses, as part of exhibitions and so on.

We will normally respond to your application within ten working days of receipt or sooner. Should you have not heard anything by this time please contact us (tradingstandards@leics.gov.uk). You will need to have specific approval to undertake any of the activities above and, consequently, tacit approval will not apply to any of these applications.

Registers

Information provided as part of an application under the Poisons Act 1972, the Performing Animals Act 1925 and the EC Feed Hygiene regulations 183/2005 will be made available on public registers. Access to these registers is made by prior appointment with the Trading Standards Service at their office during normal hours. tradingstandards@leics.gov.uk

If you have a complaint about a licence holder concerning a breach of the law relating to that licence you should contact the Trading Standards Service.
